Spotter Beta Tester Agreement

This agreement is between Spotter, operated by Kevin Kyle ("Spotter", "we", "us"), and you, the tester. It covers the Spotter closed beta.

Program window: July 20 to July 31, 2026. We may extend it in writing.

The short version

  • Do: two 30-minute workouts with Spotter on different days, at least 2 camera form-feedback sets total, analytics on, and a 5-minute exit survey.
  • Get: $25 plus free Spotter for life. Prefer to do more? An optional extended track pays $50 total instead of $25: 4 sessions total (not 2 plus 4) on 4 different days, at least 6 camera form-feedback sets across at least 2 different lifts, and the same survey. See Section 2.
  • Keep it quiet: no public posts about the app until launch.
  • Lift safe: you train at your own risk, and Spotter is not medical advice.

This box is just a summary. The numbered sections below are the agreement.

1. What you will do

The list below is the base track. If you're doing the optional extended track instead, see Section 2 for what changes (more sessions, more sets); everything else below, including analytics and staying synced, still applies.

  1. Two workout sessions with the Spotter app, each at least 30 minutes, on two different days within the program window.
  2. Form-feedback sets: at least 2 sets with camera form feedback in total, on any supported lift (Barbell Back Squat, Deadlift, Bicep Curl, Lateral Raise). Sets in a workout or through Quick Form Check both count.
  3. Analytics on: beta builds send usage analytics and crash reports while you test, and by accepting this agreement you consent to that. If the app shows an analytics prompt, turn it on and leave it on for the whole beta. This is not optional for testers: it is how we catch crashes on real phones. No name or email is attached to these events.
  4. Exit survey: complete it within 3 days after your last required session, no later than August 2, 2026. That's 3 days after your second session on the base track, or 3 days after your fourth session if you're doing the extended track in Section 2.
  5. Stay synced: stay signed in with an internet connection so your sessions upload. Completion is verified from in-app records, and sessions that never sync cannot be counted.

In-app bug reports (You, then Settings, then Feedback) are encouraged, not required.

2. What you get

  • $25, paid by Zelle, Venmo, or invoice (your choice) within 3 days after we verify you completed Section 1.
  • Extended track (optional): $50 total instead of $25. Complete four workout sessions with Spotter, each at least 30 minutes, on four different days within the program window (these four sessions satisfy Section 1's two-session requirement too, they're not in addition to it); at least 6 sets with camera form feedback in total, across at least 2 different supported lifts; and the exit survey. Paid the same way as the base payment above, within 3 days after we verify you completed these extended requirements. The extended track replaces the base payment (it is $50 total, not $25 + $50), and everything else in this agreement applies the same.
  • Free access to Spotter for life on your personal account once the app publicly launches.

Payment is all or nothing within a tier: partial completion of either tier is appreciated but does not by itself qualify for that tier's payment. If you complete the base requirements above in full but do not finish the extended track, you are paid $25, not a prorated amount. If you complete the extended track in full, you are paid $50 instead of $25, not both. If we cancel the beta early through no fault of yours: you get $25 if you had completed at least one qualifying session at the time of cancellation, or $50 if you had already fully completed the extended requirements at the time of cancellation. You are an independent volunteer tester, not an employee or contractor, and you are responsible for any taxes on the payment.

3. Your data

The app uses your phone's camera to analyze your movement during sets, and your workout data (including pose data) uploads to our servers, where we use it to operate and improve Spotter. We do not sell your data, and we will not publicly share your videos, clips, or identifiable data without your separate permission. After the beta you can request deletion of your beta data by emailing spotter@spottercoach.com.

4. Keep it private

Until Spotter publicly launches, do not publicly post or share screenshots, recordings, reviews, or details about the app (social media, blogs, press). Talking about it privately with friends and family is fine. Want to post something? Ask us first: we will usually say yes.

5. Safety and risk

Weight training carries an inherent risk of injury. You confirm you are at least 18 years old and physically able to do your normal training. Spotter provides general fitness and recovery guidance only: it is not medical advice and is not a substitute for a physician, physical therapist, or qualified coach. Train within your abilities, use appropriate safety equipment, and stop immediately if you feel pain. Your training during the beta is voluntary and at your own risk, and to the maximum extent permitted by law you release Spotter and Kevin Kyle from any claims arising out of your training activities during the beta, except claims arising from Spotter's or Kevin Kyle's gross negligence or willful misconduct.

6. The fine print

Spotter is pre-release software provided as is, with no warranties of any kind: expect bugs, and features may change, break, or disappear. Feedback and ideas you share may be used by us freely, with no payment beyond Section 2. To the maximum extent permitted by law, our total liability to you under this agreement is limited to the total payment owed to you under Section 2 ($25, or $50 if you completed the extended track). Either of us may end your participation at any time by written notice (email or text counts), with payment handled per Section 2, and Sections 3 through 6 survive the end of this agreement. This is the entire agreement between us about the beta, changes must be agreed in writing (email counts), and it is governed by the laws of the State of Maryland.

Accepting this agreement

By checking the agreement box and typing your full legal name, you confirm you have read this agreement and agree to it. Your typed name counts as your signature, and the agreement takes effect when you submit the form. No countersignature from Spotter is needed; we keep a record of your acceptance.

If you do not accept, that is completely fine, but do not install or use the beta.
